Sales Contract

We, at House of Poms, sell our Pomeranians with a Full Registration or Limited Registration.  All of our poms with a full registration have been selected with a potential of show quality.  All of our poms with a limited registration are sold as "Companion Pets Only".  We retain the right to sell or refuse to sell a pom to anyone at any time for any reason.

At House of Poms, we care very much about the future of the Pomeranian breed.  As responsible breeders, we feel that pet dogs should not be bred.  Your pet quality pom is being sold with a spay/neuter contract.  Buyer agrees to have the pom spayed/neutered by 7 months of age.  (Please remember that females normally go into heat by 6 months old).  The "Limited Registration" box on your poms registration papers will be checked to remove the incentive for you to breed.  (Should you breed the pom contrary to your agreement, puppies born of the said pom will not be eligible for registration).  When you receive your registration papers, keep them in a safe place.  We charge a refiling/replacement fee of $10 and ACA or AKC also charges a fee to replace papers which you will also be responsible for as well.  The seller will retain registration until the buyer provides proof of spay/neuter from a licensed veterinarian.  **Buyer has been made aware that if they provide the seller with spay/neuter information over 1 year after the litter is registered with ACA or AKC that the registrar may charge additional registration fees to the buyer or refuse to register the dog.  Seller has no control of determinations or fees charged by ACA or AKC.

Your purchase price includes the placed non-refundable/non-transferable deposit of $225.00 and must be received within 5 business days.  If a deposit is not received within that time frame the pom will go to the next person on our waiting list.  The balance of $________ is due in full by ___/___/___.  If the balance is not paid in full on or before the due date, or if the buyer changes their mind about the purchase of the Pomeranian for any reason, the Pomeranian will be relisted as available and the buyer will lose the deposit.  The remaining money paid towards the Pomeranian will be refunded minus the deposit (NR/NT $200.00 plus a $25.00 relisting fee which goes towards the purchase price when you complete the purchase of the Pomeranian).

Every precaution has been taken to see that your new pomeranian is not only personable and well socialized but in excellent health as we want you to be completely satisfied with your selection.  Our vet is very experienced and knowledgeable in toy breeds!!  Therefore, the pick up of your pom is arranged as follows: 

Local Sales:  Seller and buyer will meet at the sellers vet for the poms healthy check up and dewormer (depending on weight)  at 6+ weeks of ages.  You will take your pom home directly from the vet.  This ensures the seller that our poms receive their healthy check up and most importantly their first duel dose of dewormer (if vet feels it is safe to do so) from their new owners. (You may also consider discussing micro chipping at this time).  The cost of the health certificate and possible micro chipping is not included in the purchase price.  Should the buyer postpone picking up their pom, there will be a service charge of $5 per day billed for boarding fees due at the time of pick up.  There will be additional charges for any shots given.  Seller will not be responsible for any vet bills.  If dewormer is not given for safety concerns, buyer will be required to give proof of dewormer within the time frame discussed with our vet, BY our vet and seller will not be held responsible for any illness of your pom or expense you incur.  This is mandatory to start your health and congenital defect guarantee.

Long Distance Sales:  Buyer will be responsible for all shipping costs and will have their healthy check up and health certificate by our vet.  If dewormer is not given for safety concerns, buyer will be required to give proof of dewormer within the time frame discussed with our vet, seller will not be held responsible for any illness of your pom or expense you incur.  Should the buyer postpone picking up their pom, there will be a service charge of $5 per day billed for boarding fees due prior to delivery date.  There will be additional charges for any shots given. Seller will not be responsible for any vet bills.  This is mandatory to start your health and congenital defect guarantee. 

Shipping arrangements and additional shipping charges will be agreed upon between seller and buyer.

For your records: your pom was checked by our vet and given a clean bill of health on ___/___/___ .  Keep all papers in a safe place.

Local and Long Distance Sales:  If you also choose to have the pom checked by your vet, again at your cost, you will need to do so within 48 hours or 2 business days of bringing him/her home.  In the event that your vet is not satisfied with the pomeranians condition, a written assessment from your vet must be furbished.  If there is a discrepancy between our vet and your vet a 3rd separate opinion (chosen by seller)  will be issued at your expense.  The seller will not be liable for any expenses incurred by the buyer for vet bills or travel expense.  If the third vet assessment verifies health issues, buyer is responsible for dropping off the pom at the seller's residence and we will replace the pomeranian with one of equal value (chosen by the seller if one is available) or refund you the purchase price minus the deposit (if one is not available).  This contract becomes null and void and we will not assume any responsibility for the pom if a return is not made within 2 days or 48 hours of the date you took your pom home.

We do not guarantee the color, size, breeding or show quality of the pom or a change of heart about the purchase or a dislike of the pom.  Nor does it cover hypoglycemia, worms, any type of mites, fleas, broken bones, patella's or small open fontanel, undescended testicles, bites, ear set, coat type at maturity, skim problems or any condition that is treatable and not life threatening.  Please be aware that this guarantee is the same for breeder or pet homes.  We make no exceptions!  Please keep in mind that if you change your mind for any reason about the purchase of the pom at any time, you will not receive a replacement pom or a refund.  We take excellent care of our poms and only want permanent, loving homes for our poms!!

We also do not guarantee against Parvo, Giardia, Coccidia or any other contagious or infectious diseases - it is up to the new owner to prevent these.  Kennel cough is a common problem that sometimes happens; if you plan to board your pom he/she can get vaccinated against this, it is not a covered problem due to being preventable and treatable.  We provide a 7 day guarantee for contagious and infectious diseases after you take your pom home.  It is wise to discuss with your vet how to keep your pom protected against disase until and after all their vaccinations are complete.  A congenital defect is a problem that will not allow the pup to grow to a normal life expectancy...going blind, being deaf or having limp/bad knees (patella's) etc. are not considered life threatening and are not covered.  A major body organ (heart, liver, lungs, kidneys) that sustains life going bad is considered a congenital defect and is covered for the first 6 months of life.  (This must be proven at your expense by a licensed veterinarian).  Upon the buyer signing and accepting the terms of this contract, all disclosed and known health concerns or defects shall be accepted by the buyer.  The guarantee stated above will not apply to these disclosed health concerns or defects.

Your pomeranian has been raised on Bil-Jac and Eagle Pack dry puppy food and Eagle Pack Holistic canned puppy food.  We do not recommend changing this diet: however if the diet should be changed his/her stool will not be the same consistency and you could also cause constipation and/or digestive irritations.  Do not over handle the pom.  Remember, your pom is in a new environment which is a complete change from what he/she is used to.  Keep in mind that stress and over handling can cause hypoglycemia (low blood sugar).  If this happens it is up to the new owner to treat the puppy and/or go to the vet.  The seller is in no way responsible.  We recommend having NutriCal on hand to help with this.   If you have any questions about this, feel free to call and discuss how you can ease the transition and how/when to use NutriCal.  NutriCal is NOT to be used on a regular basis.  Not all toy dogs have hypoglycemia but because toy poms are so little, their play activity and any stress can deplete their sugar levels quickly, making them too tired to eat.  The main way to check this is by looking at their gums.  You can also use Karo White Corn Syrup as an instant sugar rise and an instant appetite stimulator.  If you have any questions about this, feel free to call and ask at any time.

Please read the information and treatment options for hypoglycemia attached to your contract.  Always discuss these things with your vet.  Also, please read the attached Merle Gene information if you have purchased a Merle pom.  These are both provided for your knowledge and the safe guard of your newest family member.

Toy breeds are very special.  If you do not choose to stay with our vet and take your new pom to your existing vet, it is VERY important to discuss options of when it is best to vaccinate your toy pom.  Poms should NOT be given double vaccinations so the rabies shot will be a separate vet visit rather than also given at the 16+ weeks vaccinations.  (Our vet typically gives the rabies shot a week after this last series of shots).  Because of the weight and body mass size of your pom, it is a beneficial option to postpone vaccinations for a few weeks until your puppy is a bit older and heavier.  Again, please discuss these things with your vet.  If you have any questions, please contact me.

The seller is not responsible for any accidents or injuries, physical or internal after the pom leaves the sellers care and is not covered in the health guarantee.  Failure of the buyer to notify the seller of any and all health concerns or illness within 2 days or 48 hours of receiving the vet's certification of illness will result in a forfeiture of rights of health guarantee and of this contract.

Pesticides:  
Be aware that pesticides are harmful to your pom.  When a liquid spray is used make sure that it is completely dry before exposing your poms to it.  Do NOT use crystalized pesticides due to the fact that these granules can get caught in their fur and pads of their feet and it is likely they will lick it off grooming themselves.  We do not guarantee any such illnesses or harm that comes to your pom due to the use of these products.

Buyer - is 18 years or older and is the new owner.  Buyer has read and understands the conditions of this contract and agrees to the above terms and statement.  This contract is the complete agreement between the seller and the buyer and no promises or guarantees are made unless contained here in writing.  Any changes or additions to this agreement must be in writing and signed by the buyer and the seller.

Seller accepts cash, most major credit cards or PayPal (online payment option, ask me how!  There is an additional 3.2% fee charge when you use a credit card or PayPal).  Again, any deposits that are made to hold a pom are non-refundable and non-transferable when the agreement is cancelled by the buyer.
